Welcome to ColorClerk. These Terms of Service ("Terms") govern your use of the ColorClerk application ("App") operated by ColorClerk ("we," "us," or "our"). Please read these Terms carefully before using the App.
By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

The App, including its content, features, and functionality, is owned by ColorClerk and is protected by copyright, trademark, and other intellectual property laws. Our name, logo, and all related product and service names, design marks, and slogans are trademarks of ColorClerk.
We may from time to time develop patches, bug fixes, updates, or other modifications to improve the performance of the App. These updates may be installed automatically or manually, depending on your device settings. By using the App, you consent to such automatic updates.
The App may integrate with or allow access to third-party services. We are not responsible for the content, policies, or practices of any third-party services. Your use of third-party services is at your own risk and subject to their respective terms and policies.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, COLORCLERK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (A) YOUR USE OR INABILITY TO USE THE APP; (B) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS AND/OR ANY PERSONAL INFORMATION STORED THEREIN; OR (C) ANY ERRORS OR OMISSIONS IN THE APP'S OPERATION.
You agree to defend, indemnify, and hold harmless ColorClerk, its officers, directors, employees, and agents, from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the App.
We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the App after such modifications will constitute your acknowledgment of the modified Terms and agreement to abide by them.
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
